ACCC to take Pfizer to court over Lipitor discounts

Pfizer Australia will face the Federal Court of Australia after the Australian Competition and Consumer Commission initiated proceedings in relation to the company’s pre-patent expiry deal for atorvastatin (Lipitor).

The ACCC announced it had instituted proceedings against Pfizer, “for alleged misuse of market power and exclusive dealing in relation to its supply of atorvastatin to pharmacies in contravention of the Competition and Consumer Act 2010”.
The allegations related to offers made by Pfizer to pharmacies in early 2012 for the supply of Lipitor
