Call to review penalties for homebirth deaths

A proposal to give greater recognition to the rights of the unborn child in WA’s fetal homicide laws should prompt a rethink on penalties against midwives in cases of homebirth-related deaths, AMA WA says.

The group’s president, Dr David Mountain, said last week: “If we accept that these unborn children have rights and are protected by the law, why should that only apply in situations of violence and not in situations of negligence?”

He was commenting in response to a proposal by the WA State Government to reform fetal homicide
