COVID-19 employment crisis helps sway court in PBS case

NSW pharmacy can continue operating, pending Federal Court appeal

A pharmacy that had its PBS approval scuttled by a rival can stay open pending an appeal, thanks to a Federal Court ruling that was influenced by the COVID-19 crisis.

The Vincentia MC Pharmacy PBS approval was scheduled to be set aside on 8 April after rival Choice Pharmacy Vincentia successfully challenged its approval to operate in a large medical centre in the NSW town.

But the Federal Court has agreed to allow the pharmacy to keep operating, pending the outcome of Vincentia MC Pharmacy’s appeal
