A surgeon involved in a botched operation resulting in paraplegia for the patient has successfully appealed a negligence decision that would have left him millions of dollars out of pocket.


However, the anaesthetist was not so lucky after the NSW Court of Appeal knocked back his appeal and found he was liable for the full damages of $3,828,075 plus legal costs.

The claim involved a 24 year-old patient with Noonan syndrome, who had a serious curvature of the spine resulting in increasing breathlessness and a pattern of restrictive airways disease.
