GP misses melanoma, but not found negligent
Mr Malcolm Coote “faces imminent death”, a NSW Supreme Court judge said, because of complications associated with having the melanoma removed from the plantar surface of his foot a year and a half after first showing it to GP Dr Steven Kelly in 2009.
The judge said the “awful disease which [Mr Coote] has contracted… has not been shown to have been the result of Dr Kelly’s failures”.
“On the evidence it is likely that in September 2009 the [melanoma] had already metastasised. The treatment risks he would then have faced were similar to those which confronted him in 2011,” he concluded.
The judge found in the doctor’s favour, with costs to be determined at a later date.
