After-hours doctor fails in legal bid to overturn PSR’s $460,000 payback demand

An after-hours doctor who successfully challenged a Professional Services Review order that he repay $460,000 in misclaimed Medicare rebates has been reordered to pay up after a failed legal appeal.
In 2020, Dr Hamid Norouzi was told to repay rebates for urgent after-hours MBS items he had claimed while working for the corporate deputising service House Call Doctor.
At the time a PSR committee said his notes were inadequate, failing to show that the treatment he offered was actually urgent.
He took the case to the Federal Court of Australia, arguing that the watchdog had not adequately considered whether he should only pay the difference between the urgent and non-urgent after-hours items, which would have reduced the payback demand by roughly 50%.Â
