Supreme Court overturns ban on public clinics initiating puberty blockers for teens

The decision was based on the Queensland Government failing to meet legal requirements rather than 'the subject matter', judge Peter Callaghan said.

The Supreme Court of Queensland has thrown out the State Government’s ban on public clinics initiating puberty blockers and cross-sex hormones for transgender teens.

With a 14-page judgement, Judge Peter Callaghan has ruled that the Queensland Health directive was made unlawfully because of inadequate consultation with health services.

The temporary ban began in January amid a government-ordered review of treatment protocols for gender dysphoria in children and adolescents, which is due to report back on 30 November.

Queensland Health Minister Tim Nicholls said at the time the “pause” was necessary to maintain public confidence during the review.
