Court rejects second negligence claim against radiologist over a myelogram he performed 47 years ago

Two decades after winning a negligence claim over a myelogram he performed way back in 1977, a Sydney radiologist could be forgiven for thinking the legal saga was behind him.

But then his former patient Derek Morrison, now 75, decided to take a second bite — this time, focusing on the hospital where the procedure was performed.

Representing himself, he launched a new claim in the NSW Supreme Court for damages for pain and disability caused by arachnoiditis said to have been triggered by the dye used in the procedure.

The first time, he unsuccessfully argued that the radiologist was negligent after failing to remove the Myodil after the procedure.
