Get consent for every consult with an AI scribe to comply with state surveillance laws, says MDO

A medical defence organisation is advising GPs to obtain consent every time they use an AI scribe to take consultation notes, even for repeat patients.
Dr Owen Bradfield, GP and chief medical officer at the Medical Indemnity Protection Society (MIPS), said it was necessary because some state laws meant recording a consultation without consent was a criminal offence.
“Any consultation recorded without consent would be a separate offence, so if you recorded three without consent, then that could be three counts of a single offence,” he said.
The popularity of AI scribes among GPs has gathered pace, with Best Practice announcing earlier this year it would integrate note-taking tool Lyrebird into its desktop software.
