GP fends off $238,000 negligence claim over delayed coeliac disease diagnosis

A 'reasonable' GP would not have ordered the tests based on the patient's varying symptoms, the court ruled.

A GP sued for $238,000 for not diagnosing coeliac disease in an older adult over a six-year period has won his court battle.

The District Court of NSW ruled that a “reasonable” GP would not have ordered the tests for the patient based on his varying symptoms, including low vitamin B12, low serum folate and bouts of diarrhoea.  

The patient was aged 76 when the case made it to court last year.

He consulted the NSW Riverina area GP dozens of times between January 2015 and October 2020, the court heard.
