GP takes PSR fight to High Court over demand to produce 25 years of patient records

In his court filings, Dr Matthew Yoong says his case involves 'the exercise of coercive powers by a Commonwealth regulator'.

A GP ordered to hand over 25 years of medical records to the Professional Services Review is trying to appeal to the High Court of Australia, court documents show.

Dr Matthew Yoong has been battling the Professional Services Review (PSR) since 2021, when the watchdog tried to ban him from Medicare for not providing its investigators with complete medical records for 76 patients.

The heart of the court cases was whether the PSR could demand clinical records relating to consultations from outside of May 2017 to April 2018, the period of Dr Yoong’s Medicare claims that was under review.

The first legal decision, in 2023, was that the PSR could theoretically demand extensive records, but, in Dr Yoong’s case, it had not met its legal requirement to explain to him why it needed the full records.
