Junior doctors reach $175 million agreement over unpaid overtime after four-year legal battle

Current and former junior doctors in Victoria have reached a $175 million in-principle agreement with the State Government over unpaid overtime — four years after the first class action was launched.

Under the mediated agreement, which is yet to be approved by the Federal Court of Australia, doctors who worked for any of the 36 Victorian public services from early 2015 until January this year may be eligible for back pay.

The deal comes after Victorian doctors launched the first of several class actions, in March 2021, over unpaid, unrostered overtime while working as junior doctors.

In August 2023 the Federal Court of Australia ordered Peninsula Health to pay Dr Gaby Bolton, the lead plaintiff in one class action, over $8000 in unpaid overtime from four rotations between 2019 and 2021.
