Lawyer Hayden Stephens says he thought the case was going to trial before a last-minute breakthrough.

More than 25,000 junior doctors can apply for a share of $230 million after NSW Health agreed to Australia’s largest payout in a wage-theft class action.

Dr Amireh Fakhouri, a junior doctor at Sydney’s Westmead Hospital between 2015 and 2018, spearheaded the four-year legal fight over unpaid superannuation, meal breaks, and rostered and unrostered overtime.

Lawyer Hayden Stephens said both sides were preparing for a trial to start on 6 May before they made “one final attempt at mediation”.

“We felt that, for some years now, we had been a long way apart in our discussions with NSW Health,” he told AusDoc.
