Patients are making baseless complaints against doctors by using AI to identify medical negligence, MDOs warn

MDA National says the issue is that AI does not have access to all the clinically relevant information that the doctor relied on.

Some patients are uploading their clinical information and asking AI whether their diagnosis or treatment was inappropriate before lodging complaints, a medical defence organisation says.

MDA National said the tools were at high risk of making inaccurate claims of substandard treatment, often because they were being fed incomplete information by patients ignorant of the full clinical context.

But it stressed that the complaints were time-consuming as all the details in the complaint then needed to be checked against medical records and the doctor’s account.

Radiology is particularly vulnerable to AI created complaints because patients could upload their imaging into an AI tool and ask it to interpret or identify abnormalities.
