Puberty blocker ban back in force just six hours after court ruling

Queensland's Minister for Health has used different legal powers to reissue the ban following Tuesday's Supreme Court ruling.

The Queensland Government has used alternative legal powers to once again ban public clinics from initiating puberty blockers and cross-sex hormones for transgender teens, following its Supreme Court loss on Tuesday.

The original ban began in January amid a government-ordered review of treatment protocols, but a mother whose transgender teenager was unable to access hormone therapy successfully challenged it in court.

Justice Peter Callaghan ruled that Queensland Health director-general Dr David Rosengren had failed to consult with health services before issuing a directive that affected them — as required under section 48 of the Hospital and Health Boards Act 2011.

He overturned the ban and ordered Queensland Health to cover the woman’s legal costs.
