Supreme Court backs payroll tax crackdown, declaring GPs are employees

There seems no escape from payroll tax — at least as far as the courts are concerned, after they knocked back an appeal from a GP practice claiming its $790,000 tax bill was unlawful.
The group of practices, owned by Dr Jawahar Thomas, was audited back in 2018, with NSW tax officials finding that its 40 doctors should have been classed as employees rather than contractors for tax purposes.
Dr Thomas has taken his fight through multiple appeals.
But the resulting legal rulings have so far provided justification for the NSW Revenue’s controversial attempts to claim millions of dollars in backdated payroll tax from GP practices.
