Video of Bankstown nurses allegedly menacing Israeli patients allowed as evidence after Supreme Court ruling

The trial is expected to start later this month.

The video of two Australian nurses allegedly making menacing anti-Semitic comments will be permitted as evidence in their trial, following an appeal.

The video of former Bankstown Hospital nurses Ahmad Rashad Nadir and Sarah Abu Lebdeh allegedly threatening violence towards Israeli patients, or to refuse to treat them, was recorded and published by Israeli social media content maker Max Ilinsky after matching with the pair on the app Chat Roulette.

The two nurses were charged with using a carriage service to menace and harass, with Ms Ledbeh also charged with threatening violence to a group. Both have pleaded not guilty. 

In June, NSW District Court judge Michael McHugh ruled that the video recording was obtained illegally, and inadmissible as evidence, despite being a significant plank of the prosecution’s case.
