Who will take the blame when AI goes wrong — companies or doctors?

A lawyer says companies have tactics for pushing legal blame onto doctors.

The difficulty of suing huge technology companies means doctors are more likely to bear the legal consequences if AI software goes wrong, experts warn.

A panel of doctors and lawyers at the 34th Annual Medico-Legal Congress in Sydney last week agreed there was little legal precedent on liability for AI-related errors.

But Samuel Wolfhagen, a lawyer at Maliganis Edwards Johnson, said the difficulty of seeking compensation from foreign technology companies was a concern for doctors.

“A lot of those companies are likely to be in Silicon Valley and in the hands of a few major players with a huge amount of resources to fight claims like this,” he said.
