GP’s appeal on obesity payout

Sydney GP Dr Emm­anuel Varipatis will ask the NSW Court of Appeal to overturn the ruling that bariatric surgery would have been an appropriate treatment in 1998 when his patient, Luis Almario, developed cirrhosis in relation to obesity. 

That later developed into liver cancer and the man has been given 40 weeks to live.

Dr Varipatis’ indemnifier, Avant, said its appeal, lodged earlier this month, challenged the ruling “on a number of grounds, including the finding that Dr Varipatis was negligent in failing to refer Mr Almario direct to a bariatric surgeon in 1998”.
