Mother of 12 loses discrimination claim against hospital

Tracey and Eric Wilson, together with their 12th child Sophia, alleged Western Health discriminated against them by excluding Mrs Wilson from the program in the sixth month of her pregnancy because she was 44 and already had more than 10 children.

Mrs Wilson had previously had 11 home births and two at birth centres between 1987 and 2008, with all babies delivered by her husband Eric with and without the assistance of midwives. She had also had three miscarriages, in 1987, 1998 and 2007.

The Wilsons took action under the state’s Equal Opportunity Act and asserted breaches of human rights under Victoria’s Charter of Human Rights and Responsibilities Act.
